CBP-Blaine Federal Tort Claim

In July 2026, the ACLU and ACLU affiliates across 17 states and D.C. brought 54 claims under the Federal Tort Claims Act (FTCA) on behalf of individuals whose rights were violated by federal law enforcement. Here in Washington, the ACLU-WA is representing a family of asylum seekers, including four children, held in deplorable conditions in a small cell in Blaine for roughly four weeks. The family is seeking damages resulting from CBP’s decision to detain the family in conditions that harmed their wellbeing and ignored CBP’s own policies.
